Breaking News: Due to the differences in some of the provisions in the new constitutions preliminary draft, the drafting committee failed to submit the draft to full CA meeting yesterday. Now that such issues raised by UCPN Maoists are settled by editing some and removing Multiparty parliamentary democracy and the Local election within six months of constitution promulgation, the edited first draft is submitted today in the evening. Following the submission in full CA meeting, some of the lawmakers from Madhesi parties and RPP-Nepal who were against the 16 point deal obstructed the process. Some Madhesi lawmakers even tore the draft copies.

June 29, 2015: The constitution drafting committee on June 28, Sunday has finalized the first draft of the new constitution of Nepal. Despite resolving all contentious issues, the committee has endorsed the draft, putting the vote of dissents in it. The drafting is made possible with rounds of discussion in subcommittees and high ranking leaders within 15 days, due to the recent 16 point deal between the major four political parties. It is known that the draft will be presented in the full CA meeting today and it is quite possible that the new constitution will be delivered with in next month through short cut.

Despite resolving all contentious issues, the committee has endorsed the draft, putting the vote of dissents in it. The drafting is made possible with rounds of discussion in subcommittees and high ranking leaders within 15 days, due to the recent 16 point deal between the major four political parties. It is known that the draft will be presented in the full CA meeting today and it is quite possible that the new constitution will be delivered with in next month through short cut.
The draft of the new constitution is found to contain 37 parts and 296 articles which may be changed or edited as per the discussion in the full CA meeting. Among the contentious issues for the constitution, the committee has proposed the following, among which some are the key components of new constitution.
- Discussion to continue on contentious issues and amend of some provision until the final one.
- Vote of dissents are not a part of the draft but put there for further discussion.
- Citizenship in the name of Father or mother.
- Special citizenship to Non resident Nepalese, without political rights.
- 60 percent FPTP and 40 PR in state assemblies as well.
- Secularism to continue with freedom of any religion.
- 8 States (Name and demarcation to be determined by a committee).
- Bicameral legislation (275 Parliament and 45 National assembly members)
- New Prime Minister, President and Parliament head election to be held within a month after promulgation of new constitution.
- Five unamendable provisions.
With the draft ready to be submitted, major political parties will power to deliver the constitution and opposition parties to move ahead writing dissents on the draft, it seems the new constitution will be delivered within this year, as a matter of fact within next month. The new constitution of Nepal 2072 is the first constitution made by the people through constituent assembly ( the second one). Though the Constitution of Nepal 2047 is also called to be made by the people of Nepal, it has many unamendable provisions, giving high powers to King and Royal Family. Now that the country is republic, the new constitution has only five such unamendable provisions for Independence, Sovereignty, territorial integrity, Multiparty democracy and sovereignty vested in people of Nepal. The other issues in the new constitution can be amended by a two third majority of federal parliament.
Though I (as a citizen) completely agree with the provisions in the new constitution, I am happy that the dream of writing our own constitution by our representatives (without any interference from neighbors and some big kings) is about to come true. And you all know after getting the new constitution, we all have a new day for the celebration marking the day of promulgation of the new constitution also called Constitution day.
